Gujarat Land Revenue Act: The Gujarat government under the leadership of Chief Minister Bhupendrabhai Patel has taken a historic and revolutionary decision in the field of land revenue. According to state spokesperson minister Jitubhai Vaghani, the government has taken steps to simplify the revenue process. The Land Revenue Act, 1879" Significant amendment has been made in Section 135-D of the Act. With this decision, citizens will no longer have to wait for a notice period of 30 days in legitimate transactions of land or property. In the non-disputed cases, the document will be permanently registered on the day itself, which will result in speedy disposal of about 50,000 pending cases of the Revenue Courts and will provide a major relief to the general public from unnecessary harassment and disputes
Why was this decision taken? Blackmailing will be stopped
Until now, it was mandatory to give 30 days' notice at the time of sale of land or property. Taking advantage of this long period, some anti-social elements and middlemen used to raise false objections. As the price of the property increased, some people used to blackmail the buyer or seller by intimidating them on the basis of old bonds or raw notes. Understanding this pain of the farmers and the middle class, the Chief Minister has taken a bold decision to exempt from this 30-day notice system, so that people can act without fear
In which case will the note be recorded on the same day?
As per the new amendment, notice 135-D will not be required if the following conditions are met and the sale deed will be certified and 'Permanent Entry' will be made on the same day:
land records should not have changed for the last 1 year or more.
There is no litigation or litigation pending on the land and there is quiet possession
All the entitlements appearing in the landing record of7/12 have signed the sale deed.
Further, no notice will be served at the time of recording of orders of the competent court or tribunal, the same will be directly implemented><
7 days' notice
in cases requiring investigation, the government has also given a big relief. If there has been any change in the record in the last 1 year, the sale has taken place through Power of Attorney (PoA), the signature of all the entitlements of 7/12 is not in the document or if there is a case pending... In such cases, the notice period has been reduced from 30 days to just 7 days. In these 7 days, the genuine beneficiaries will be able to submit their proofs so that no injustice is done to anyone
