The woman from Palanpur diocese was married according to the Muslim religion. However, the husband was physically and mentally tortured. He had divorced twice. If he uttered this word for the third time, his house would be devastated. However, the counsellor of the Palanpur Mahila Sahayata Kendra explained to her by teaching her a lesson in the law. And admitted the mistake. Before the woman's family of Palanpur diocese was ruined, the counsellor of the Women's Assistance Centre explained to her husband by teaching him a lesson in law. In this regard, Jigishaben Taral said that two months ago, the husband had pronounced talaq orally twice. This incident forced them to live in fear and uncertainty. As the matter became serious, the woman sought help from the police station based support centre. Therefore, both the husband and wife were given legal guidance according to Muslim law. At the same time, an attempt was made to lead to a solution by listening carefully to both the parties by counselling the case. During the counselling, the husband admitted his mistake. The husband confessed that they used to make false threats by uttering the word talaq in anger or under pressure. He assured that no further threat or behaviour of such talaq will be met. During the counselling, both of them were explained the legal process of talaq as per Muslim law, its seriousness and the importance of mutual understanding in marriage. In India, the practice of triple talaq, i.e. instant divorce by saying talaq once, talaq three times, is now illegal. The Muslim Women (Protection of Rights on Marriage) Act, 2019 came into force after the Supreme Court judgement of 2017. According to the Act, instant triple talaq by oral, written or electronic means is void. The husband can be jailed for up to three years and fined. The wife has the right to apply to the court for financial assistance and custody of the children.
