Swatantra Bhardwaj's lawyer asks how he dared to arrest him: Says Supreme Court quashes cases related to Jantar Mantar, then how can an FIR be filed

The Delhi High Court on Monday held a hearing on the arrest of Swatantra Bhardwaj. Bhardwaj's lawyer said that when the Supreme Court had quashed all the FIRs related to the Jantar Mantar case, how dare the Delhi Police go to Bulandshahr in Uttar Pradesh and arrest him. The police challenged this claim and said that the FIR in the present case has not been cancelled. The court sought a clear answer from the Delhi Police on whether the FIR in question is still there or not. The court gave the police the option to give an immediate statement or file an affidavit. Meanwhile, the court extended Bhardwaj's judicial custody by 14 days till September 21. Bhardwaj was produced before Special Judge Saurabh Pratap Singh Laled via video conferencing from Tihar Jail in connection with the attack on Sanjay Azad on June 23. Bhardwaj was taken into custody by the police on September 4 and was taken into custody in Bulandshahr on September 4. He was then brought to Delhi. On September 5, the court allowed the police to conduct a day's custodial interrogation. He was then sent to one-day judicial custody on Sunday. The arrest took place amid a controversy that followed a video podcast. In which Bhardwaj allegedly claimed that he broke the head of Sanjay Azad during the Jantar Mantar protest. He also said that Section 307 of the IPC was invoked due to the attack. Later, Bhardwaj claimed that he did so in self-defence. Swatantra Bhardwaj-Nishu Azad case: Sequence of events September 4: CJP leaders and supporters staged a protest outside the Parliament Street police station in support of Nishu Azad and his father. Lawyer Rishabh Ranjan, appearing for Nishu, demanded that the police add relevant sections of attempt to murder, criminal intimidation and SC/ST Act. The police added these sections. Swatantra was taken into custody. September 5: Hindu outfit staged a protest in Delhi in support of Swatantra Bhardwaj. The protest was called by Daksha Chaudhary. Daksha is known for beating up and slapping high-profile people. He also slapped Kanhaiya Kumar. Victim, accused and Delhi Police's side in the assault case. 1. Victim Party- Sanjay Kumar/Nishu Azad CJP activist Nishu Azad's father Sanjay Kumar was injured during the CJP protest at Jantar Mantar on June 23. A case was registered at the Parliament Street police station on Sanjay's complaint. Nishu alleges that his father's head was broken and even after a month and a half, the police did not take adequate action. 2. Accused - Swatantra Bhardwaj Swatantra Bhardwaj claimed in a viral podcast that he attacked Sanjay on the head and he received 60 stitches. He also said that he did not have to go to jail. Later, Bhardwaj retracted his statement and said that it was not an attack but self-defence. He claims that 10-15 people surrounded him and the mob could have killed him if he had not acted in defence. 3. Delhi Police's side According to the police, Sanjay Kumar suffered an injury on his head on June 23 after being hit by a bracelet. Sanjay was taken to RML Hospital for a medical examination. The injury was said to be normal in the medico-legal case. The police termed the claim of skull fracture/fracture as false. Earlier, the police called Swatantra for questioning but later released. Now, after pressure from the CJP, he was taken into custody again and new sections were added to the case.
