The Judicial Magistrate Court of Patan has sentenced Rs. An important verdict has been given in the cheque return case of Rs 4,21,000. The court also sentenced Pankaj, the administrator of a trust in Palanpur, to one year simple imprisonment and to pay the full amount of the cheque as compensation within 30 days. What is the whole incident?
The complainant, Jigar Tailor, had trained 210 students for 120 days in the classes of Shivan and Beauty Parlour in Patan. The classes were run by a Foundation and Charitable Trust in Palanpur. According to the MoU signed between the two sides, a total of Rs. 14,40,000 was to be paid, out of which Rs. A sum of Rs. 13,68,000 was to be recovered. The accused Pankaj had earlier paid Rs 100 per student. A total of Rs. 3,000 each. 4,50,000, out of which Jigar Tailor received only Rs. Rs 2,51,700 was paid. Out of the remaining amount, Rs. A cheque of Rs. 4,21,000 was given and another Rs. 6,95,300 was promised to be paid in future. The cheque was returned to the bank
Jigar Tailor had deposited the cheque in the account of his firm's AU Small Bank. However, on July 9, 2019 and thereafter on August 3, 2019, the cheque was returned due to insufficient funds in the accused's account. Judicial proceedings
Despite repeated collections, the money was not paid, the complainant approached lawyer H.N. A complaint was filed under Section 138 of the Negotiable Instruments Act in the Patan court. At the end of the hearing, the magistrate Dr. Hiralben P. Joshi has convicted the accused and ordered punishment and compensation.
