Builder alleges construction of compound wall in adjacent land: Illegal construction dispute under heavy power line

A dispute has arisen over the construction of a plot of land near Chamunda Chowk Road in Mehsana. The owner of the old survey no. 1150 along with the land of his survey number 1150/2 has also filed an application before the Collector under the Land Grabbing Act, which is being heard. On the other hand, the woman petitioner has also filed a written application with the municipal corporation to remove this illegal construction, following which the municipal corporation has conducted a hearing. The matter has come to the fore after the construction of a complex of 21 shops under the heavy power line near Chamunda Chowk was embroiled in a land ownership dispute. Bhagwatiben Patel and four other sisters have about 16 gunthas of land jointly owned by the elders of Chamunda Chowkadi Road touch. A suit is also going on in the Upper Revenue Court on the issue of 6 gunthas of land falling under the government limits. These 22 gunthas of land are adjacent to the old survey no. Bhagwatiben has filed an application under land grabbing alleging that it was encroached upon by Suleman Mistry of 1150. Rajendra Kumar Paldia, who is currently managing the land on behalf of Bhagwatiben, said that Sulemanbhai has illegally encroached on the land of four sisters, including Ramilaben, by building a compound wall. After re-measurement, all the records, 7/12, 8-A, City Survey and City Measurement Sheet have been submitted to the Municipal Corporation. However, the defendant did not appear in the hearing in the Municipal Corporation and the Collector. Notice to submit Aadhaar Evidence Sources in the municipal corporation said that Sulemanbhai Mistry had obtained the construction permit during the time of the municipality and the construction was currently underway. However, since the issue of the construction taking place on another person's land falls under land grabbing, the petitioner has been advised to take legal action in this regard. In which the land ownership will be clarified through the DILR measurement. The corporation has issued a notice to present evidence regarding the construction. Now the matter will be heard.
